Stuart Mermelstein is a native of New York City. In 1981, he graduated summa cum laude from the University of Miami with a Bachelor of Business Administration (B.B.A.). Stuart went on to attend law school at the State University of New York at Buffalo, graduating magna cum laude in 1986. From 1985 to 1986, he was the executive editor of the Buffalo Law Review.
After law school, Stuart spent ten years as a commercial litigator with prestigious international law firms. In the mid-1990s, he joined Jeff Herman’s law firm. He has worked with Jeff on sexual abuse cases nationwide for more than two decades.
Stuart takes a hands-on approach to our clients’ cases, and also leads our firm’s appellate practice group. Recently, Stuart prevailed in an appeal to the Eleventh Circuit Court of Appeals in a federal case involving a 14 year old public school student raped by her math teacher, establishing a new precedent for bringing a federal claim in such cases under Title IX. In a reported decision, the Eleventh Circuit reversed the trial court’s grant of summary judgment. Doe v. School Bd. of Broward County, Fla., 604 F.3d 1248 (11th Cir. 2010).
Stuart is a member of the bars of the State of New York and the State of Florida. He is also a member of the bars of the U.S. District Court, Southern and Eastern Districts of New York; the U.S. Court of Appeals, Fifth Circuit; the United States Court of Federal Claims; the U.S. District Court, Northern District of Florida; the U.S. District Court, Middle District of Florida. the U.S. District Court, Southern District of Florida; and the U.S. District Court, Western District of Pennsylvania.
