1 800 686 9921Father James R. Porter was a priest in the Diocese of Fall River with a deeply troubling history of sexual abuse spanning multiple states, including Massachusetts, New Mexico, Minnesota, and Texas. He was laicized in 1974, married, and had four children. Over the years, Porter was named in numerous civil suits brought by survivors of his sexual abuse across multiple states. He has been accused of sexually abusing hundreds of children in parishes and other settings throughout his assignments. In 1993, Porter pleaded guilty in Massachusetts to sexually assaulting 28 children and was sentenced to 18 to 20 years in prison. More than 100 claims were ultimately settled across multiple jurisdictions, reflecting the extensive scope of his conduct. Porter died in February 2005 while incarcerated.
Because Porter is deceased, civil claims related to his abuse are typically directed at the Diocese of Fall River and other institutional defendants that may have enabled or concealed his conduct over many years.
In Massachusetts, a settlement was announced in October 2023 involving a 70-year-old survivor who reported being sexually abused at age 8 in Attleboro. This case is a powerful example of the enduring impact of Porter’s actions — and of the courage it takes to come forward decades later. Porter’s case illustrates how abuse frequently occurred across multiple assignments and communities, and how institutions may bear responsibility for enabling that pattern of harm.

Depending on the circumstances, survivors of Father James R. Porter’s abuse may be able to pursue civil claims under Massachusetts law. Civil litigation not only examines the conduct of the individual perpetrator but also investigates institutional responsibility — including whether the Diocese adequately supervised Porter and responded to allegations against him.
Civil settlements and court judgments may provide financial compensation to support recovery, while also creating a documented public record that may help prevent future abuse. Legal action can empower survivors to assert their voice, seek accountability, and ensure their stories are heard.
Massachusetts law has evolved to better recognize the challenges survivors of childhood sexual abuse face in coming forward, and legal options may exist even for older claims. An attorney familiar with clergy abuse litigation can assess the potential viability of your claim. Pursuing civil remedies can be one path toward healing and toward reinforcing the broader message that abuse cannot be ignored or excused.
