O’Toole, also known as “Brother Alois,” joined the Xaverian Brothers in 1935 and served in high schools and missions across the United States and abroad, including Louisville, KY; the Bronx and White Plains, NY; Baltimore, MD; East Africa; and Shrewsbury, MA. As a member of the Xaverian Brothers religious order, he served at St. John’s High School in Shrewsbury, Massachusetts, which is located within the Archdiocese of Boston. According to the Xaverian Brothers, these allegations were unrelated to students at Xaverian schools. He passed away in Venice, Florida, in 2006 at the age of 90. He also appears on the Archdiocese of Baltimore’s list of accused clergy, released on July 23, 2019, He is also listed in Appendix A of the Maryland Attorney General’s Report dated April 5, 2023, which identifies him among clergy associated with the Archdiocese of Baltimore who are credibly accused of abuse occurring outside of Maryland.

Survivors of Brother Donald J. O’Toole may carry lifelong impacts from childhood sexual abuse, including emotional trauma, psychological distress, and disrupted relationships. Civil litigation may offer survivors a path to recognition and formal acknowledgment of the abuse. Legal claims may examine not only the individual’s conduct but also the role of the Xaverian Order and affiliated institutions in supervising Brother O’Toole and in responding to the 1989 report of abuse.
Depending on the circumstances, Massachusetts law may allow for civil actions despite delayed reporting, recognizing the psychological and social barriers that prevent survivors from coming forward earlier. Civil remedies may provide financial compensation, formal acknowledgment of survivors’ experiences, and a public record documenting the abuse. An attorney can help you understand whether your potential claim may be viable.
Pursuing justice also supports institutional accountability — helping to ensure that similar misconduct is prevented in the future. Civil litigation that addresses institutional oversight failures can reinforce accountability standards and contribute to child protection reform within religious institutions.
