Sexual Assault Lawsuit Filed Against Westside Regional Medical Center
WHAT: JEFF HERMAN, a nationally-recognized attorney for victims of sexual abuse, announces the filing of a lawsuit against WESTSIDE REGIONAL MEDICAL CENTER for the sexual assault of a female patient by PATRICK BARRY, a hospital security guard.
According to the Complaint:
- On or about November 29, 2010, TALI DUKE transported herself to the emergency room at Westside Regional Hospital for heart related concerns. While Duke was being treated for her heart concerns, the treating doctor feared that she would harm herself. On this basis, the doctor had Duke detained under the “Baker Act”.
- Due to her detention under the “Baker Act,” Westside Regional assigned hospital security to watch Tali Duke until she was discharged. One of the security guards assigned to Duke was Patrick Barry.
- On or about November 30, 2010, Patrick Barry forced himself onto Tali Duke by grabbing her face and kissing her. Barry touched Duke inappropriately on her breasts, lower back and buttocks, and rubbed his groin against her arm. Barry thereafter continued to sexually assault Tali Duke on the premises of Westside Regional.
- While in the care and custody of Westside Regional, Tali Duke’s blood pressure was extremely low and she was being medicated with morphine for pain, rendering her dizzy, weak, and extremely vulnerable to the sexual assaults committed by Patrick Barry.
TALI DUKE v. COLUMBIA HOSPITAL CORPORATION OF SOUTH BROWARD d/b/a WESTSIDE REGIONAL MEDICAL CENTER was filed in Broward County Court this morning.
