Sexual Assault Lawsuit Filed Against Indian River Medical Center
WHAT: JEFF HERMAN (www.hermanlaw.com), a nationally-recognized attorney for victims of sexual abuse, announces the filing of a lawsuit against INDIAN RIVER MEDICAL CENTER for the sexual assault of a female patient by a male nurse.
According to the Complaint:
- On or about July 25, 2013, Jane Doe was transported by a friend to Indian River Medical Center (IRMC). Jane Doe remained in the Emergency Department overnight under the control of Nurse Wigley.
- While Jane Doe was lying on a bed in a room in the Emergency Department, Jane Doe’s friend observed strange behavior from Nurse Wigley regarding his comments to Jane Doe. Specifically, Nurse Wigley told Jane Doe that she was cute and he would like to take her home with him. Shortly thereafter, Nurse Wigley instructed Jane Doe’s friend to go home.
- Alone, Jane Doe advised Nurse Wigley that she felt nervous and afraid. Nurse Wigley began stroking Jane Doe’s arm, telling her how pretty she was, and that “everything was going to be fine.” He then began kissing Jane Doe and forced his tongue into her mouth. Nurse Wigley inappropriately touched Jane Doe’s breasts and proceeded to insert his finger in Jane Doe’s vagina. Finally, Nurse Wigley forced Jane Doe’s hand on his penis.
- While in the care and custody of IRMC, Jane Doe was recovering from sedation induced by prescription medication, rendering her dizzy, weak, and extremely vulnerable to sexual assaults committed by Nurse Wigley.
JANE DOE No. 44 v. INDIAN RIVER MEDICAL CENTER (Case 2014 CA 000698) was filed Tuesday in Indian River County, Florida Circuit Civil Division. A copy of the complaint is available upon request.
