MEDIA ALERT: Bus Driver Sexually Molested Girl on School Bus in Westchester County, Lawsuit Says

***MEDIA ALERT*** NEWS CONFERENCE TODAY AT 12:30 PM Bus Driver Sexually Molested Girl on School Bus in Westchester County, Lawsuit Says WHAT: JEFF HERMAN (www.hermanlaw.com), a nationally-recognized attorney for victims of sexual abuse, announces the filing of a lawsuit against MILE SQUARE TRANSPORTATION for the sexual abuse of K.W., an 11-year-old student who was transported to and from school on a MILE SQUARE bus, by Ernesto Ortiz, the bus driver on K.W.’s bus. This case is the first to be filed from the nationwide practice’s new office, Herman Law New York. According to the Complaint: • K.W. was an 11-year-old female student who was transported to and from school on a MILE SQUARE BUS. Her bus driver was Ernesto Ortiz. • In or about the Fall 2013 school semester, Ernesto Ortiz began committing acts of sexual assault and battery upon K.W. on the MILE SQUARE bus, including putting his hands into her pants and fondling her vagina. • On or about October 28, 2013, Ernesto Ortiz sexually assaulted K.W. on the MILE SQUARE bus. On this date, the bus monitor, Fiormelissa Torres, observed inappropriate behavior by Ernesto Ortiz toward K.W. Fiormelissa Torres knew or should have known that this conduct made it reasonably foreseeable that Ernesto Ortiz engaged in misconduct of a sexual nature with K.W. on the bus. • On or about October 29, 2013, Ernesto Ortiz sexually assaulted K.W. on the bus once again. Fiormelissa Torres once again observed inappropriate behavior by Ernesto Ortiz toward K.W. similar to the behavior she had observed the day prior. • After the bus dropped students off, Fiormelissa confronted K.W. about what she observed and K.W. disclosed, “he’s touching my stuff”. K.W. additionally informed her mother that Ernesto Ortiz had been committing sexual acts upon her on the bus. • Ernesto Ortiz pleaded guilty to the charge of Endangering the Welfare of a Child. Jeff Herman, the attorney for the victim in this case, stated: “A school bus service must ensure that students are transported safely to and from school without being sexually assaulted by the bus driver.” K.W. v. MILE SQUARE TRANSPORTATION, INC. was filed today in The Supreme Court of the State of New York County of Westchester.
