Gov. Cuomo Signs Child Victims Act in New York

Governor Andrew Cuomo signed the New York Child Victims Act into law Thursday morning, February 14, 2019, marking a massive victory for survivors of sexual abuse. The new law creates a one-year window in which victims of childhood sexual abuse can file a civil lawsuit no matter how long ago they were abused. Additionally, the Child Victims Act extends the statute of limitations on civil claims going forward, allowing victims until age 55 to file lawsuits.

Herman Law Managing Partner Jeff Herman was in attendance at Gov. Cuomo’s bill signing ceremony yesterday, held at the New York Daily News’ headquarters in Manhattan.

“I am so proud to be a part of this historic moment for survivors of sexual abuse. For too long, victims of sexual abuse in New York have had to suffer in silence as a result New York’s extremely restrictive statute of limitations. I look forward to working on behalf of the thousands of survivors in New York who now have been given a voice thanks to the passage of the Child Victims Act.”
– Jeff Herman

The one-year window to file previously barred sexual abuse cases begins six months from the signing of the bill.
